C1T3L5 · Revised 2026-10-26

Decision and objectives

Practical task: Annotate a real disclosure set and reject an unsupported guarantee claim

Objectives: Locate the governing disclosure set; Distinguish asset separation from value protection; Resolve a conflict between a short form and detailed terms.

Required prior knowledge: C1T3L4. Classification: domestic. Revision: 2026-10-26. All fictional names, prices, rates, fees, calendars and tax schedules below are hypothetical unless explicitly identified as a dated document observation.

The statement “assets are protected” can refer to separation from a service provider's estate, not protection against market losses. Read the sentence's subject, responsible party, event and remedy. A regulatory approval, a custodian name and a risk indicator each supply information; none alone promises repayment of the purchase amount.

Mechanics

The prospectus explains the fund's strategy, valuation, dealing, expenses, risks and rights. The investor information form summarizes key features and should be read alongside it. Portfolio reports show holdings at a stated observation date; financial reports provide accounting and audit context; material notices can change terms. An official disclosure platform is a location for documents, not a guarantor of outcomes.

Build an evidence register: identifier, document title, publication date, relevant section, claim and unresolved question. A recent marketing summary cannot silently override a governing document. If documents conflict, obtain the effective version and clarification before relying on the disputed term.

Price and return drivers

Asset separation aims to distinguish the portfolio from the founder's or custodian's own assets under the applicable legal framework. Portfolio liabilities, investment losses and lawful liquidation expenses can still reduce unit value. A guarantee requires an identified provider and enforceable conditions. A capital-protection objective based on investment strategy is different from a third party promising to fill a shortfall. Dates, eligible units, currency and permitted exit route determine the scope.

Worked case

Dated annotation: in the TI1 prospectus notified 2026-09-15, section IV concerns asset separation; section III discusses investment risks; section V concerns valuation; section VI governs dealing. The 2026-09-21 investor form adds a risk-profile summary and fee table. The correct reading connects these sections rather than extracting the custody paragraph as a capital promise. The short form's caution about risk indicators is a reason to read underlying risks.

Separate hypothetical case: an investor pays TRY 40,000 for ordinary units. Portfolio value declines 12% and the supplied exit charge is TRY 50. Redemption cash is 40,000 × 0.88 − 50 = TRY 35,150 before investor tax; loss versus cash paid is TRY 4,850. A distributor's statement “held in custody” does not supply the missing TRY 4,850.

Adverse case

Suppose a promotional page says “principal secure,” while the detailed fictional document says merely “aims to limit losses at the scheduled maturity.” An early-sale valuation of TRY 34,000 on a TRY 40,000 investment implies a TRY 6,000 pre-cost loss. If the investor must exit before maturity, a protection objective at maturity cannot be inserted into today's sale cash. If a true guarantee exists, default or claim-processing risk of its provider must still be analyzed. Do not invent a guarantee provider because the distributor is a bank.

Practical use

Use KAP and the issuer's official document repository, matching fund code and legal name. Retain the dated version and current amendment notices. Check unit records through the applicable intermediary/central-record services; holding records establish quantity, while the prospectus governs rights. Expenses already enter NAV as applicable; investor fees and tax-net redemption need separate calculation. Actual tax questions require the full year/status/acquisition/effective-date record. This document lesson intentionally does not infer tax treatment from a marketing label or an old form.

Decision boundaries

A document set is sufficient for a decision only when material rights, cash dates, costs and loss paths can be explained. Defer the investment if “guaranteed” lacks a named guarantor, covered amount, currency, trigger and claim process. A decision to wait is justified by missing evidence, not by a belief that all funds are unsafe. Conversely, ordinary market risk is compatible with a well-administered, transparently documented fund.

Practice and references

Exercise: a hypothetical ordinary fund investment of TRY 75,000 is marked down 8%; investor exit fee is TRY 100. A custody paragraph promises separation of assets but no investment-value guarantee. Answer: 75,000 × 0.92 − 100 = TRY 68,900 before tax, a TRY 6,100 loss. Identify three records: the effective prospectus for rights, portfolio/financial disclosure for valuation context and transaction/holding records for quantity. None turns the loss into an insured deposit claim.

Takeaway: identify the event covered by a protection clause before assuming what it protects.
